日頃は弊社の教科書をご利用いただき誠にありがとうございます。 

文化庁ウェブサイト等においても公表されておりますとおり、今般の新型コロナウイルス感染症に伴うオンライン授業等のニーズに対応するため、本年４月２８日から、著作権法３５条に関する「授業目的公衆送信補償金制度」が施行されることとなりました。

これにより、一定の場合には、個別の著作権者の許諾を得ずに教員等がオンライン授業のために著作物を必要な限度において複製し、受講学生に送信することができるようになりました。

弊社が出版している教科書および付随の電子データや映像ファイルなどの教材につきましても、大学等の授業において個々の受講学生が購入することを想定して販売・提供しているものであるため、今後も、個別の著作権者の許諾なくして利用することができない点にご留意ください。

そのうえで、弊社では４月２８日から施行される「^※授業目的公衆送信補償金制度」に則っていただくことを前提といたしまして、つぎのように対応させていただいております。

◆　教科書をご講義にてご採用いただき、かつ各受講学生によりご購入いただく場合に限り教科書および付随教材を、許諾なくオンライン授業にご利用いただけます。

◆　弊社へ教科書の複製データ（PDFデータ）の提供をご依頼いただく際には、データの取り扱いについてのみ、期間・分量・方法等の条件を設けさせていただいております。ただし、教科書によっては、弊社で複製データをご用意できないものもございます。

[Important] Guidance on the “Use of Textbooks in Online School Classes”

Dear Teachers Using Our Textbooks:

As announced on the website of the Agency for Cultural Affairs and other websites, in response to address the needs of online school classes due to the new coronavirus pandemic, the "remuneration system for public transmission for school lessons" regarding Article 35 of the Copyright Act became into force as of April 28, 2020.

As a result, under certain conditions, teachers became able to duplicate copyrighted materials to the extent necessary for their online class and transmit them to the students taking the class without obtaining individual permission of the copyright holder.

However, even after April 28, 2020, i.e., the date above system became into force, you can use the copyrighted materials without copyright holder’s permission pursuant to Article 35 of the Copyright Act only when "the interests of the copyright holder would not be unreasonably prejudiced."

The textbooks we publish and attached materials such as electronic data and video files are sold and provided with the intention that those will be purchased by individual students for the class at universities or others.  Thus, please continue to note that you cannot use our textbooks and attached materials without permission of the individual copyright holder.

In the meanwhile, subject to your complying with the "remuneration system for public transmission for school lessons" which became into force from April 28, 2020, please follow the instructions below.

- You can use our textbooks and attached materials in your online school class without permission only if they are adopted for your class and purchased by each student in the class.

- When you request us to provide duplicate data (PDF data) of the textbooks, we will set terms of use for handling of data, such as period, amount, method, etc.  Please note that we may not be able to meet your request for some textbooks.

We will continue to make every effort to provide sufficient support to the teachers using our textbooks.  We apologize for any inconvenience and would appreciate your kind understanding.

A： No, it is not.  Textbooks must be adopted for your class and purchased by each student in the class.

A： You can use the audio data that are downloadable or available for streaming on our website in your online class.  Please handle with care when you use in your online class the audio recorded in the CDs separately provided to teachers only, such as the audio for exams.
